HOW IT WORKS



The defendant is taken to the Madison, Rankin or Hinds County Jail for processing and booking, which can take approximately 4-8 hours. During this time, the defendant is photographed for their “mug shot”, all their personal possessions are removed, they will be fingerprinted and other warrant checks and booking processes will be conducted. They will be eligible for bail once all the booking procedures are completed.


To set the bail amount, the jail employees will use the Madison, Rankin or Hinds County Bail Schedule, which is adopted by county judges on an annual basis. This is the time that you typically will receive a phone call from the defendant while in jail to contact a bail bondsman and make arrangements for their release.


The fee for using a bail bondsman is 10% of the entire bail amount. For example, if bail is set at $20,000, your fee to the bondsman will be $2,000. Once the fee is paid, the bondsman will go to the jail and “post” the bail bond. Typically, the defendant is released within 2 to 4 hours.


How Bail Is Set

After arrest and during the processing of a defendant, bail is set. County judges set the amounts for bail  annually. The judges will lie out a “bail schedule” detailing each type of charge and setting a corresponding bail amount. Bail amounts may be set differently from the bail schedule based on prior criminal record, severity of the crime and circumstances surrounding to the case.
